LeaseBuddy LLC: Terms of Service & User Consent

1. Nature of Service
LeaseBuddy LLC ("LeaseBuddy," "we," "us," or "the Platform") provides a digital venue for users to browse, list, and communicate regarding roommate searches and housing subleases.
- Neutral Intermediary: LeaseBuddy is not a real estate broker, landlord, property manager, or insurance provider. We do not own, inspect, manage, or control the properties listed.
- No Party to Contracts: Any agreement (verbal or written) formed between users—including leases, subleases, or roommate agreements—is strictly between those users. LeaseBuddy is not a party to, nor responsible for, the performance or breach of any such agreements.
2. Public Visibility & Guest Access
By using the Platform to post a listing, you acknowledge and agree to the following:
- Public Data: Certain information, including property photos, pricing, and general descriptions, will be visible to the general public (unauthenticated "Guests") to facilitate discovery.
- Protected Data: Sensitive information, including your Full Name, Exact Street Address, Map Location, and Messaging Interface, is restricted. This data is only accessible to registered users who have agreed to these Terms.
- User Discretion: You are responsible for ensuring that photos, titles or descriptions uploaded to the Platform do not inadvertently reveal private information you wish to keep hidden from the public.
3. Accuracy of Information & User Verification
- "As-Is" Content: LeaseBuddy does not vet, screen, or verify the accuracy of user-generated content, profiles, or listings. We make no guarantees regarding the safety, quality, or legality of any advertised property.
- Due Diligence: Users are solely responsible for conducting their own inspections and background checks before exchanging funds or signing legal documents.
4. Subleasing & Legal Compliance
If you list a sublease on LeaseBuddy, you represent and warrant that:
- You have the legal right to sublease the premises under your original lease agreement.
- You have obtained any necessary written consent from your landlord or property manager.
- You are responsible for any administrative fees (e.g., "Sublease Fees" or "Transfer Fees") required by your building management.
- LeaseBuddy is not liable for any evictions, fines, or legal actions resulting from a user's violation of their primary lease terms.
5. Financial Transactions & Third-Party Tools
- Independent Payments: LeaseBuddy does not process, hold, or escrow funds. Any use of third-party payment processors (e.g., Stripe, Venmo, PayPal) is subject to the terms and conditions of those specific providers.
- No Dispute Resolution: LeaseBuddy will not mediate financial disputes regarding security deposits, rent payments, or application fees. Users conduct transactions at their own risk.
6. Limitation of Liability & Indemnification
- No Warranty: The Platform is provided on an "as-is" and "as-available" basis without warranties of any kind.
- Indemnity: You agree to indemnify, defend, and hold harmless LeaseBuddy LLC and its officers from any and all claims, damages, or legal expenses (including attorney fees) arising from:
- Your use of the Platform.
- Your interaction or disputes with other users/landlords.
- Any injury, loss, or property damage occurring at a property found via the Platform.
7. User Conduct & Data Privacy
- Prohibited Behavior: Users may not post fraudulent listings, engage in harassment, or use the Platform for any illegal purpose.
- Data Rights: You may request the deletion of your account and personal data at any time by contacting neven.stark@leasebuddy.org. We store data using industry-standard encryption to protect your privacy.
